Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Presence (“Service”) operated by Presence from Ontario, Canada. By creating an account, connecting Fanvue, or using the Service, you agree to these Terms and our Privacy Policy.

If you do not agree, do not use the Service.

1. The Service

Presence is an off-platform tool for Fanvue creators that helps draft, schedule, and send fan chat replies using AI, persona settings, memories, vault metadata, and automation rules you configure. Fans interact with you on Fanvue; they do not use Presence directly.

Features may include sandbox testing, an approval inbox, autopilot mode, PPV suggestions, analytics, and related creator tooling. We may add, change, or remove features at any time.

2. Eligibility

  • You must be at least 18 years old.
  • You must have a valid Fanvue creator account in good standing, including any identity verification Fanvue requires.
  • You must have authority to bind yourself or the business entity that operates the Fanvue account.
  • You must not be barred from using the Service under applicable law.

3. Account & Fanvue authorization

You sign in through Fanvue OAuth. We never ask for your Fanvue password. By connecting, you authorize us to access and act on your Fanvue account within the OAuth scopes you approve, including reading chats and fan data and sending messages when your settings allow.

You are responsible for maintaining the security of your session and device. Notify us immediately at presence.fanvue@gmail.com if you suspect unauthorized access.

You may revoke access at any time by disconnecting the app in Fanvue and/or requesting account deletion per our Privacy Policy.

4. Automation & your responsibility

You control whether replies require manual approval or can send automatically, subject to per-fan overrides, fan lists, emergency stop, and other settings in the Service.

  • You are solely responsible for all messages sent from your Fanvue account, whether drafted by AI or written by you.
  • You must review automation settings and test in sandbox before enabling autopilot on live fans.
  • AI-generated content may be inaccurate, inappropriate, or inconsistent with your intent. Use approval mode when in doubt.
  • You must comply with Fanvue's terms, community guidelines, and applicable law, including rules for adult content on Fanvue itself.

Presence's own interface, marketing, screenshots, and notifications remain safe-for-work (SFW). You may use the Service to manage adult creator businesses on Fanvue, but you must not use Presence to display, store, or distribute explicit content in our UI or listing materials.

5. Acceptable use

You agree not to:

  • Harass, exploit, dox, threaten, or discriminate against any person.
  • Facilitate illegal activity, minors in sexual contexts, or non-consensual content.
  • Impersonate Fanvue, Fanvue staff, or other creators.
  • Bypass Fanvue safeguards, rate limits, moderation, or OAuth scope restrictions.
  • Reverse engineer, scrape, or abuse the Service or Fanvue API beyond documented use.
  • Introduce malware or attempt unauthorized access to our systems.
  • Use the Service to send spam or unsolicited bulk messages in violation of Fanvue policy.
  • Misrepresent what the Service does or what data it accesses.

We may suspend or terminate access for violations, risk to other users, or legal requirements.

6. Fees & billing

Some plans may be free during beta. Paid plans, when offered, may be billed through the Fanvue App Store using Fanvue payment rails where required. Pricing, trial periods, reply limits, and overage terms will be shown at checkout or on our pricing page.

  • Fees are non-refundable except where required by law or stated at purchase.
  • We may change pricing with notice; grandfathered pricing may apply to active subscriptions where stated.
  • If you do not pay applicable fees, we may downgrade or suspend paid features.
  • You must not circumvent Fanvue billing for paid functionality listed on the Fanvue App Store.

7. Intellectual property

We own the Service, software, branding, and documentation. You retain ownership of your persona content, notes, and Fanvue account materials. You grant us a limited license to process your content solely to operate the Service.

Feedback you provide may be used without restriction or compensation.

8. Third-party services

The Service integrates with Fanvue and other providers. Your use of Fanvue is governed by Fanvue's terms. We are not responsible for Fanvue outages, API changes, account actions taken by Fanvue, or third-party services outside our control.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee uninterrupted operation, error-free AI output, specific revenue outcomes, or that automation will meet every fan expectation. The Service is not legal, financial, or compliance advice.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRESENCE AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED CANADIAN DOLLARS (CAD $100).

Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the fullest extent permitted by law.

11. Indemnification

You will defend, indemnify, and hold harmless Presence, its operators, and suppliers from claims, damages, and expenses (including reasonable legal fees) arising from your use of the Service, content you send through Fanvue, violation of these Terms, or violation of third-party rights.

12. Termination

You may stop using the Service at any time. We may suspend or terminate access with or without notice for breach, risk, inactivity, or discontinuation of the Service.

Upon termination, your right to use the Service ends. You may request deletion of your data as described in our Privacy Policy. Sections that by nature should survive (limitations of liability, indemnification, governing law) will survive termination.

13. Governing law & disputes

These Terms are governed by the Province of Ontario and the federal laws of Canada, without regard to conflict-of-law rules. You agree to the exclusive jurisdiction of the courts located in Ontario, Canada for disputes that cannot be resolved informally, except where consumer protection law in your jurisdiction requires otherwise.

14. Changes

We may modify these Terms from time to time. We will post updates on this page and update the “Last updated” date. Material changes may require additional notice. Continued use after changes take effect constitutes acceptance.
